Terms of Service

1. Acceptance of Terms

By accessing or using PropulSell ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

PropulSell is an AI-powered SaaS platform that transforms photos of clothing items into professional product listings, including enhanced images, titles, descriptions, and hashtags optimised for resale platforms such as Vinted, Depop, and Poshmark.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect at any time with reasonable notice.

3. Account Registration

You must create an account to access the Service. You agree to:

  • Provide accurate and complete information during registration
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorised access
  • Be responsible for all activity that occurs under your account

    • You must be at least 16 years old to use PropulSell. Accounts created for minors require parental consent.

    4. Subscription & Payment

    PropulSell operates on a subscription model. By subscribing to a paid plan:

  • You authorise us to charge your payment method on a recurring basis (monthly or annually)
  • Subscriptions auto-renew unless cancelled before the renewal date
  • No refunds are issued for partial subscription periods, except where required by law
  • Price changes will be communicated at least 30 days in advance
  • All prices are inclusive of applicable VAT

    • Payments are processed by Stripe. We do not store your payment details.

    5. Credits & Usage

    Each plan includes a monthly credit allowance for AI generations. Credits:

  • Reset on your billing anniversary date
  • Are non-transferable and non-refundable in cash
  • Are not cumulative — unused credits expire at the end of each billing cycle
  • Are refunded if a generation fails due to a technical error on our end (not due to image quality issues)

    • 6. Acceptable Use

    You may not use PropulSell to:

  • Upload images of prohibited goods (counterfeit items, weapons, illegal products)
  • Process images of people without their consent
  • Attempt to reverse-engineer, scrape, or abuse our AI systems
  • Resell or sublicense access to the Service
  • Use the Service for any unlawful purpose or in violation of platform marketplace rules

    • Violations may result in immediate account suspension without refund.

    7. Intellectual Property

    You retain full ownership of the original photos you upload. You grant PropulSell a limited, non-exclusive licence to process these images solely for the purpose of delivering the Service.

    The AI-generated outputs (enhanced images, titles, descriptions) are provided to you under a commercial licence for use in your resale listings. PropulSell retains ownership of its platform, AI models, and underlying technology.

    8. Disclaimer of Warranties

    The Service is provided on an "as is" and "as available" basis. PropulSell makes no warranties, express or implied, regarding:

  • The accuracy or completeness of AI-generated content
  • Uninterrupted or error-free operation
  • Results or outcomes from using the Service (including actual sales increases)

    • AI-generated listing content should always be reviewed before publication.

    9. Limitation of Liability

    To the maximum extent permitted by law, PropulSell's total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

    10. Termination

    Either party may terminate the agreement at any time. Upon cancellation:

  • Your access continues until the end of the current billing period
  • Your data is retained for 90 days then permanently deleted
  • You may export your generated listings before deletion

    • 11. Governing Law

    These Terms are governed by the laws of France. Any disputes shall be resolved by the courts of Paris, France, except where applicable consumer law grants you the right to bring proceedings in your country of residence.
