Terms of Service

1. Acceptance of Terms

By accessing or using PropulSell ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and others who access the Service.

The Service is a software owned and operated by ADERYX AI LAB LLC, a limited liability company (LLC), registered office: 30 N Gould St Ste N, Sheridan, Wyoming 82801, United States, registration number 2026-002086327.

2. Description of Service

PropulSell is an AI-powered SaaS platform that transforms photos of clothing items into professional product listings, including enhanced images, titles, descriptions, and hashtags optimised for resale platforms such as Vinted, Depop, and Poshmark.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect at any time with reasonable notice.

PropulSell is an independent product. Vinted, Depop, Poshmark, eBay, Leboncoin, Vestiaire Collective and other platform names are trademarks of their respective owners and are used only to describe compatibility; PropulSell is not affiliated with or endorsed by them.

3. Account Registration

You must create an account to access the Service. You agree to:

Provide accurate and complete information during registration

Keep your login credentials confidential

Notify us immediately of any unauthorised access

Be responsible for all activity that occurs under your account

You must be at least 16 years old to use the free plan and at least 18 years old (or the age of majority where you live) to buy a paid plan or credit pack.

4. Subscription & Payment

PropulSell is offered through paid subscriptions (monthly or annual) and optional credit packs. The seller is ADERYX AI LAB LLC. Payments are processed by Stripe (Stripe Payments Europe, Limited, or its affiliate Stripe, Inc., depending on your location). By subscribing to a paid plan:

You authorise us, through Stripe, to charge your payment method on a recurring basis (monthly or annually) until you cancel

Subscriptions renew automatically at the then-current price unless cancelled before the renewal date

The price, currency and any applicable taxes are shown at checkout before you pay; we may change prices for future renewals with at least 30 days' notice

You can cancel at any time from Studio → Billing → Cancel plan; cancellation stops future renewals and access continues until the end of the paid period

Refunds are governed by our Refund Policy: /refund

If a payment fails, Stripe may retry the payment; we may restrict paid features until payment succeeds

We do not store your card details. Stripe's own terms and privacy policy (https://stripe.com/privacy) apply to the processing of your payment.

5. Credits & Usage

Each plan includes a monthly credit allowance for AI generations, and you may buy additional credit packs. Credits are a prepaid usage allowance for the Service. They:

Have no cash value and cannot be transferred, sold or exchanged for cash, except where our Refund Policy or applicable law provides otherwise

Monthly plan credits reset on each billing anniversary. Purchased credit-pack credits expire one month after purchase; any unused pack credits are removed at expiry. Promotional or referral credits follow the terms shown when offered

Are non-transferable

Are restored to your balance if a generation fails because of a technical error on our side. This restores credits and is not a cash refund

May be granted as free sign-up or referral rewards, which carry no monetary value and may be changed or withdrawn for abuse

6. Acceptable Use

You may not use PropulSell to:

Upload images of prohibited goods (counterfeit items, weapons, illegal products)

Upload or generate images of real people without their explicit consent, or create face swaps, deepfakes, voice impersonations or content that imitates a real person

Attempt to reverse-engineer, scrape, or abuse our AI systems

Resell or sublicense access to the Service

Use the Service for any unlawful purpose or in violation of platform marketplace rules

7. Intellectual Property

You retain full ownership of the original photos you upload. You grant ADERYX AI LAB LLC a limited, non-exclusive licence to process these images solely for the purpose of delivering the Service.

The AI-generated outputs (enhanced images, titles, descriptions) are provided to you under a commercial licence for use in your resale listings.

The platform, software, AI models, brand, interfaces and documentation belong to ADERYX AI LAB LLC, which grants you a personal, non-exclusive, non-transferable right of use for the duration of your subscription.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. PropulSell makes no warranties, express or implied, regarding:

The accuracy or completeness of AI-generated content

Uninterrupted or error-free operation

Results or outcomes from using the Service (including actual sales increases)

AI-generated listing content should always be reviewed before publication.

9. Limitation of Liability

ADERYX AI LAB LLC's liability is limited to direct damages and, to the maximum extent permitted by law, shall not exceed the amounts you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential losses, nor for force majeure events or the acts of third parties.

10. Termination

You may cancel your subscription at any time. ADERYX AI LAB LLC may terminate the agreement by giving you 30 days' notice, and may suspend or terminate it immediately for a serious breach that is not corrected. When you cancel a subscription, access continues until the end of the paid billing period and the account itself remains open. Cancellation does not delete saved content. You can export or delete your account from Studio > Settings. When you delete your account, we delete saved content from active systems, except records we must retain by law; backup copies may remain until overwritten in our normal backup cycle.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA. The parties will first try to resolve any dispute amicably; failing that, the courts of Sheridan County, Wyoming have jurisdiction, except where mandatory consumer law grants you the right to bring proceedings in your country of residence.

12. AI-Generated Content

Images, videos, models and text produced by the Service are generated by artificial intelligence. Fashion models created with the Service are entirely synthetic and are not based on any real person; any resemblance to a real person is coincidental.

You are responsible for reviewing outputs before use and for complying with the rules of the platforms where you publish them, including any requirement to disclose AI-generated or AI-edited images

Do not present AI-generated people as real individuals in a way that could mislead buyers

We may label or embed metadata in outputs to indicate that they are AI-generated, and you must not remove it where the law requires it

Outputs may be inaccurate or similar to outputs produced for other users

13. Sanctions and Export Controls

You may not use the Service if you are located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, or if you are listed on a sanctions list that applies to us or to our payment provider. We may refuse orders from certain regions for the same reason.
